These Affiliate Terms & Conditions ("Affiliate Terms") govern your participation in the Pleasur.ai Affiliate Program ("Program"). By applying to or participating in the Program, you agree to be bound by these Affiliate Terms in addition to our Terms of Service and Privacy Policy.
The Pleasur.ai Affiliate Program is managed through Trackdesk, our third-party affiliate tracking platform. By joining the Program, you also agree to comply with Trackdesk's terms of service and acceptable use policies as applicable to affiliates.
1. Program Overview
The Pleasur.ai Affiliate Program allows approved affiliates ("Affiliates", "you") to earn commissions by referring new paying customers to Pleasur.ai through unique tracking links provided via the Trackdesk platform. Commissions are earned when referred users complete qualifying purchases as defined in these terms.
2. Eligibility and Enrollment
2.1 Application
To participate in the Program, you must submit an application through our affiliate portal. Pleasur.ai reserves the right to accept or reject any application at its sole discretion and without obligation to provide a reason for rejection.
2.2 Requirements
To be eligible, you must:
- Be at least 18 years of age or the legal age of majority in your jurisdiction
- Have a valid website, social media presence, or other online platform
- Comply with all applicable laws and regulations in your jurisdiction
- Provide accurate and complete information during the application process
- Not be a resident of any jurisdiction where participation in the Program would be prohibited
2.3 Account
Upon acceptance, you will receive access to your Trackdesk affiliate dashboard, which provides your unique referral links, performance tracking, commission reports, and payout information. You are responsible for maintaining the confidentiality of your affiliate account credentials.
3. Commission Structure
3.1 Earning Commissions
You earn a commission when a user you refer to Pleasur.ai through your unique tracking link completes a qualifying purchase (subscription or credit purchase). The commission rate, structure, and any applicable tiers are detailed in your Trackdesk affiliate dashboard and may be updated from time to time at Pleasur.ai's discretion.
3.2 Recurring Commissions
Where applicable, recurring commissions may be earned on subscription renewals made by referred users, as specified in your affiliate agreement. Recurring commissions continue for as long as the referred user maintains an active paid subscription, unless the Program terms are modified or terminated.
3.3 Attribution and Cookie Duration
Referrals are tracked through cookies placed when a user clicks your affiliate link. The cookie duration (attribution window) is specified in your Trackdesk dashboard. If a referred user clears their cookies or uses a different device, the referral may not be attributed to you. Last-click attribution applies unless otherwise specified.
3.4 Non-Qualifying Transactions
Commissions will NOT be earned on:
- Self-referrals (purchasing through your own affiliate link)
- Transactions that are refunded, charged back, or reversed
- Fraudulent or manipulated transactions
- Transactions from users who were already existing customers prior to clicking your link
- Transactions generated through prohibited promotional methods
4. Payment
4.1 Payment Threshold
Commission payouts are processed once you reach the minimum payout threshold as specified in your Trackdesk dashboard. Commissions below the threshold will accumulate until the threshold is met.
4.2 Payment Schedule
Payments are processed on a monthly basis, typically within 30 days after the end of the calendar month in which the commission was earned. A holding period may apply to new commissions to account for potential refunds and chargebacks.
4.3 Payment Methods
Payments are made through the methods available in the Trackdesk platform, which may include bank transfer, PayPal, or other supported payment methods. You are responsible for providing accurate payment information and for any fees associated with receiving payments.
4.4 Taxes
You are solely responsible for all taxes, duties, and levies applicable to your affiliate earnings. Pleasur.ai may request tax documentation (such as a W-9 or W-8BEN form) as required by applicable law. Pleasur.ai may withhold taxes from your payments where required by law.
5. Promotional Guidelines
5.1 Permitted Promotion
You may promote Pleasur.ai through:
- Your personal website or blog with original content
- Social media platforms (in compliance with each platform's advertising policies)
- Email marketing to your own opt-in subscriber lists
- Content creation (reviews, tutorials, comparisons)
- Other channels approved by Pleasur.ai
5.2 Prohibited Promotional Methods
The following promotional methods are strictly prohibited:
- Spam: Unsolicited emails, messages, or comments in forums, social media, or other platforms
- Misleading claims: False or exaggerated claims about Pleasur.ai's features, pricing, or capabilities
- Brand bidding: Bidding on "Pleasur.ai", "Pleasur", or similar branded keywords in paid search advertising without prior written approval
- Cookie stuffing: Forcing affiliate cookies without genuine user interaction or click
- Incentivized traffic: Offering cash, points, rewards, or other incentives to users in exchange for signing up through your affiliate link, unless explicitly approved
- Adult advertising networks: Promotion through advertising networks or placements that violate applicable laws or regulations
- Trademark infringement: Using Pleasur.ai's trademarks, logos, or branding in a misleading way, or creating domains that contain "pleasur" or similar variations
- Illegal promotion: Any promotional activity that violates the laws of your jurisdiction or the jurisdiction of the target audience
5.3 Disclosure Requirements
You must clearly disclose your affiliate relationship with Pleasur.ai in compliance with applicable laws and regulations, including but not limited to the U.S. Federal Trade Commission (FTC) guidelines, the UK Advertising Standards Authority (ASA) rules, and equivalent regulations in your jurisdiction. Disclosures must be clear, conspicuous, and placed in close proximity to your affiliate links.
5.4 Content Standards
All promotional content must comply with our Community Guidelines and Blocked Content Policy. You may not promote Pleasur.ai in connection with illegal content, hate speech, content involving minors, or any content that would violate our policies.
6. Intellectual Property
Pleasur.ai grants you a limited, non-exclusive, non-transferable, revocable license to use our approved marketing materials, logos, and branding assets solely for the purpose of promoting Pleasur.ai under this Program. You may not modify, alter, or create derivative works from our branding materials without prior written approval.
All intellectual property rights in the Pleasur.ai brand, platform, and marketing materials remain the exclusive property of Pleasur.ai. Your participation in the Program does not grant you any ownership interest in our intellectual property.
7. Data and Privacy
Affiliate tracking is managed through Trackdesk, which uses cookies and other tracking technologies to attribute referrals. By participating in the Program, you agree that referral data (click timestamps, conversion data, commission amounts) will be collected and processed through Trackdesk.
You must comply with all applicable data protection laws (including GDPR and CCPA where applicable) in your promotional activities. If you collect personal data in connection with your affiliate activities, you are responsible for obtaining appropriate consent and maintaining compliance with applicable privacy laws.
8. Term and Termination
8.1 Term
These Affiliate Terms remain in effect for as long as you participate in the Program. Either party may terminate the affiliate relationship at any time, for any reason, with or without cause.
8.2 Termination by Pleasur.ai
Pleasur.ai may terminate your participation in the Program immediately and without notice if you:
- Violate any provision of these Affiliate Terms
- Engage in fraudulent or deceptive practices
- Use prohibited promotional methods
- Bring the Pleasur.ai brand into disrepute
- Violate any applicable law or regulation
8.3 Effect of Termination
Upon termination, you must immediately cease all promotional activities and remove all Pleasur.ai affiliate links and marketing materials from your platforms. Earned commissions that have met the minimum payout threshold and are not subject to dispute will be paid according to the normal payment schedule. Unpaid commissions below the minimum threshold are forfeited upon termination.
9. Program Modifications
Pleasur.ai reserves the right to modify any aspect of the Program at any time, including commission rates, cookie duration, payment terms, and these Affiliate Terms. Material changes will be communicated to active affiliates via email or through the Trackdesk dashboard. Your continued participation after changes are communicated constitutes acceptance of the updated terms.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLEASUR.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THE PROGRAM, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST COMMISSIONS, OR BUSINESS INTERRUPTION.
Pleasur.ai's total aggregate liability under these Affiliate Terms shall not exceed the total commissions paid to you in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Pleasur.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your participation in the Program, your promotional activities, or your violation of these Affiliate Terms.
12. Relationship of Parties
You are an independent contractor. Nothing in these Affiliate Terms creates a partnership, joint venture, employment, or agency relationship between you and Pleasur.ai. You have no authority to bind Pleasur.ai or make representations on our behalf beyond what is expressly authorized in these terms.
13. Governing Law
These Affiliate Terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms shall be resolved through binding arbitration, except where prohibited by law in your jurisdiction.
